OUR COMMITMENT TO PRIVACY

Your privacy is important to Accel-KKR and our affiliates (together, ‘our’, ‘us’, ‘we’ or ‘company’).  We want you to fully understand what personal information we collect from you and what we do with it.  “Personal information” means any information that relates to you from which you can be identified.  We believe that you should have full control over your personal information.  We do not disclose your personal information to anyone without your prior written consent (subject to the very narrow extent specified below).  Please read this Privacy Policy carefully.  By accessing our site, you agree to this Privacy Policy.  

For the purposes of applicable EU laws, Accel-KKR will be a data controller of any personal information collected by us. If you have any questions regarding our use of your personal information, or this Privacy Policy, please submit a request on our Contact Page.

We rely on various legal bases under applicable data protection legislation in order to process your personal information (e.g., name, title, address, telephone number, email, IP address), including our legitimate interests, contractual necessity, and as required by law. We use the personal information we collect to operate our business and perform essential business operations. We do not collect any special categories of personal information about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.

You do not need to take any action as a result of this Privacy Policy, but you do have certain rights as described below in the section headed ”Your Privacy Rights and Choices”.

HOW WE OBTAIN YOUR PERSONAL INFORMATION

Information You Provide to Us

We collect your personal information when you decide to interact with us and we only collect the information necessary to carry out our business for the purposes set out below. You can provide us with personal information via email, post, telephone, our Contact Page, or in person.  If you use the Contact Us feature on our Contact Page, your name, telephone, and email address are visible to us.

We also process information in relation to companies that we are evaluating in connection with a potential investment in or purchase of such companies. This personal information is obtained via third parties or publicly available sources.  

When you visit our site, our site analytics provider collects your IP address and browser (aggregated with our other users).

WHY WE USE YOUR PERSONAL INFORMATION

To the extent that you provide us with any personal information, through or in connection with this website (i.e., via telephone, email, messaging, our Contact Page, or post), we may use such information to keep a record of your relationship with us and for internal marketing purposes (as detailed below).

No automated decision-making, including profiling, is used when processing your personal information.

MARKETING

We will send you direct marketing communications based on our legitimate business interests where we have an existing relationship with you. We have not, and will never, sell your personal information. You may opt out of certain kinds of marketing, and all forms of marketing at any time, by going to our Contact Page and submitting a message. You can also click on the “unsubscribe” link provided in all our marketing emails.

DISCLOSURE AND TRANSFER OF PERSONAL INFORMATION

Unfortunately, the transmission of information and data via the Internet is not completely secure. Although we follow industry standards to protect your personal information, we cannot guarantee the security of any information or data transmitted to or through our website; any transmission of information or data by you to or through this website is at your sole risk.

We use your name and email address to securely confirm your identity.  We use your personal information to process and communicate with you regarding your inquiries and requests.  We may communicate with you by email, postal mail, telephone and/or text message, depending on the contact information you have provided to us.

Your personal information will be shared with and processed by our affiliates and certain service providers as necessary to fulfill the purposes set out in this policy, including professional advisors, recruitment firms, consultants and data hosting providers. We make sure anyone who provides a service to, or for us, enters into an agreement with us to follow industry standard security policies, applicable data protection laws, and to keep your information confidential. 

We may use your personal information, such as your site visit history, to enhance the information and services we provide.  We use your IP address, aggregated with other users, to improve our site and better understand and serve our users.

We reserve the right to disclose your personal information as required by law, or when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, request from a regulator, law enforcement investigation, national security, for the purposes of public importance or any other legal or investigatory process involving us. Should we, or any of our affiliated entities, be the subject of a takeover, divestment or acquisition we may disclose your personal information to the new owner of the relevant business and their advisors on the basis of our legitimate interest.

SECURITY AND RETENTION OF PERSONAL INFORMATION

We are committed to protecting the personal information you entrust to us. We adopt industry standard technologies and policies, so the information we have about you is protected to the extent reasonably possible from unauthorized access and improper use. In addition, we limit access to your personal information to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal information on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal information breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

Our website data, including your personal information is linked to secure cloud storage with AWS as facilitated by a secure third party website services agency.

We will keep your personal information only for as long as is reasonably necessary for the purposes set out in this Privacy Policy, unless a longer retention period is required by law. We will not keep more information than we need for those purposes. For further information about how long we will keep your personal information, please submit a request on our Contact Page.

CAPACITY

This website is only intended for individuals who are at least 13 years of age. We do not knowingly encourage or solicit visitors to this website who are under the age of 13 or knowingly collect personal information from anyone under the age of 13 without parental consent. If we learn we have collected or received personal information from an individual under the age of 13, we will delete that information.

COOKIES

Information regarding how you access this website (e.g., browser type, access times, and Internet Protocol (IP) address) and your hardware and software is automatically collected through the use of cookies (a small text file placed on your hard drive) or other technologies or tools. This information is used to improve website performance and for our business purposes. You may opt out to accept cookies automatically by changing the settings on your browser. If you opt out of certain cookies, you may not be able to access certain parts of this website. DO NOT TRACK SIGNALS

Some mobile and web browsers transmit “do-not-track” signals.  Because at this time, there is no general agreement on how companies should interpret do-not-track signals, we do not currently respond to do-not-track signals, whether a signal is sent or received on a computer or on a mobile device.

THIRD-PARTY APPLICATIONS

We may link to certain third-party websites on our site.  Your use of the third party websites, applications, and any information you instruct us to send to the third party will be subject solely to the third-party’s terms and conditions and privacy policy and will not be subject to any agreements you have with us or this Privacy Policy.  

CROSS-BORDER DATA TRANSFERS

Subject to your permission or as permitted by law, the personal data that you provide to us may be transferred among our affiliates across state or country borders. We have adopted globally recognized privacy principles and only collect and/or share your personal information to the extent it is necessary to conduct business and perform requested services. Where personal data originating from the European Economic Area (EEA) is transferred to countries that are not recognized by the European Commission as offering an adequate level of personal information protection, such transfers are covered by alternate safeguards. These include entering into the appropriate data processing agreements, and if required, EU standard contractual clauses for the transfer of information as approved by the European Commission.

The California Consumer Privacy Act of 2018 (“CCPA”), effective as of January 1, 2020, requires businesses that collect personal information of California residents to make certain disclosures regarding how they collect, use, and disclose such information. California consumers have the right to request:

  • Deletion of their personal information
  • Additional information about our use and disclosure of their personal information
  • Specific pieces of personal information we have about them

  • To make requests, California consumers may use our Contact Page.  A toll-free number will be provided in an update to this Privacy Policy.  Currently, please use our telephone number +1 (650) 289-2460 and ask for the Legal Department. Consumers will be required to submit their email address, and may also be asked to provide their name, location, and telephone number so that we can verify the request. California law permits California consumers to use an authorized agent to make privacy rights requests. We require an authorized agent to provide us with proof of the California consumer’s written permission (e.g., a power of attorney) that shows the authorized agent has the authority to submit a request for the California consumer. An authorized agent must follow the process described above to make a request, and we may additionally require the authorized agent to verify his/her own identity and registration to do business in California and we may confirm the agent’s authority with the California consumer about whom the request was made.

NOTIFICATION OF CHANGES

We reserve the right to amend this Privacy Policy from time to time by updating this Privacy Policy. If we decide to change our Privacy Policy, we will post those changes so our users are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. If at any point we decide to collect personal information or use any collected information in a manner different from that stated at the time it was collected, we will notify applicable users. We will use information only in accordance with the Privacy Policy under which the information was collected.

Accel-KKR makes no representation that the use of the Site outside of the United States is appropriate or lawful. Accessing this Site from countries or territories where such access is illegal is prohibited.
